I applaud the Commission’s action in developing this rule. The Commission’s unanimous approval of this rule is a huge step forward, and I believe it will motivate parties to act reasonably and facilitate dispute resolution within the industry.

Keeping the supply chain operating fairly and efficiently is a matter of utmost importance.  This rule has resulted in guidance that will surely make a positive difference in the industry.  It will help restore a sense of fairness for shippers and intermediaries, and make sure the incentive structure properly works for all stakeholders.

I would like to take this opportunity to express my gratitude to Rebecca Dye and her counsel Bob Blair for their outstanding work on this issue.  I also commend the many representatives from several shippers, intermediaries, terminal operators, and carriers who volunteered their time to participate in Commissioner Dye’s invaluable working groups.
